On World Bank-financed works, the 30% local-labour floor earns no points but can sink a bid
World Bank-financed works tendered internationally require bidders to commit at least 30% of labour cost to local labour, as a binding contract term. More earns nothing: only the method statement can be scored, within quality weightings of 50% to 80% on large contracts of high or substantial risk.

For works contracts that World Bank borrowers tender internationally with the Bank’s standard documents, and advertise on or after , bidders must allocate at least 30% of total labour cost to local staff and personnel. Only the Bank, through the borrower’s procurement strategy, can agree otherwise. The Bank’s guidance calls the 30% a threshold, not a ceiling: a bid offering more gets no extra evaluation credit, preference or price advantage, and is simply treated as responsive. Compliance is assessed pass or fail, and a bidder that does not commit to the 30%, or qualifies its commitment, gives the borrower grounds to declare its bid non-responsive.1 The percentage can cost a bidder the contract but never win it.
Measured on wages, not headcount
Local labour means the staff and personnel a contractor hires from within the borrower’s country. It excludes the contractor’s foreign personnel, including those already working in the country on another contract. The 30% is a share of the contract’s total labour cost, and for this purpose costs mean wages only. The Bank says that measuring it on cost rather than on the number of people hired gives contractors flexibility, and an incentive to offer local workers skilled jobs as well as lower-skilled ones. Where a bidder uses local subcontractors, only the labour part of each subcontract counts toward the 30%, not its full value, and foreign staff may still be hired, counted in the rest of the labour cost.1, 2 Work placed with local firms helps only through its wage bill, not its value, so a contractor whose own crews come from abroad has to show where the local wages will come from: its own payroll or its subcontractors’.
The 30% need not be the only local-labour term in a tender: the guidance lets borrowers add project-specific requirements to the works requirements, such as further training, registration or certification of certain trades in the country, a share of apprenticeships or a gender mix.1
Where the points are: the method statement, inside a compulsory quality weighting
Under the updated request for bids for works, each bid includes a Local Labour Method Statement, a form in the technical part that sets out the workforce by skill category in full-time equivalents, the share of each category filled locally, the hiring strategy and any plans for training and upskilling. Rated criteria may not score the percentage offered, but may score the quality of that statement and the bidder’s approach to training, skills development and gender, and the borrower may set a minimum technical score that every bidder must reach.1, 2
Since , rated criteria have been compulsory in every international competition that must use the standard documents, except for pharmaceuticals, vaccines and commodities, and they are evaluated in two envelopes. The weighting given to them is 50% to 80% where procurement risk is high or substantial and the contract is of high value, meaning an estimated US$10 million or more, and 10% to 40% where a high-value contract’s risk is moderate or low. The borrower places each contract in this matrix and explains the choice in its procurement strategy for the Bank’s review and approval; misapplying the weightings may lead to misprocurement. Where rated criteria are used, the contract goes to the highest-ranked substantially responsive bid from a bidder that meets the qualification criteria, not to the lowest evaluated cost.3, 4, 5 On a contract of US$10 million or more placed at high or substantial risk, at least half of the ranking rests on quality, and the local-labour part of it turns on the method statement.
After award, a contract term with a withholding
A bidder that commits to the 30% is bound by it: the guidance treats the commitment as contractual and enforced as such. The method statement becomes one of the contract documents, and the contractor’s employment records, sent to the Engineer every month, must show which workers are local. If the contractor fails to comply materially with its method statement, an amount assessed by the Engineer may be withheld until the obligation is met.1, 2 The borrower reports the contractor’s compliance to the Bank quarterly, or as its procurement plan specifies, whether or not the Bank reviews the contract in advance; where it does, any material change to the requirement needs the Bank’s no objection.5 So a shortfall can hold back the contractor’s payments, not merely appear in the borrower’s reports to the Bank.
Exceptions are agreed before the tender, not in the bid
The borrower cannot change the percentage on its own. Only in special circumstances, and with the Bank’s agreement recorded in the procurement strategy, may the two agree an alternative arrangement, including a lower percentage. The guidance gives small states, fragility, conflict and violence, and emergencies as examples; an emergency here means a natural or man-made disaster, not an avoidable delay that has made a purchase urgent. The borrower must explain any such case in full in its procurement strategy, with evidence from its market analysis or consistent feedback from several contractors at its most recent early market engagement. In the standard request for bids, the bid data sheet states whether the requirement applies and, if it does not, the arrangement agreed with the Bank.1, 2 A bidder that finds the 30% hard to meet in a given country has no route to a lower figure through its bid: contractors’ views of local capacity count at the borrower’s early market engagement, before the tender, and the bid data sheet shows what was agreed.
Award notices show prices, not scores
Borrowers, not the Bank, run these procurements, from seeking bids to awarding and managing the contract; for open international competition the Bank publishes the procurement notice on its own website, and the award notice too. The award notice must list every bidder’s price as read out and as evaluated, the bids rejected with the reasons, and the winner’s final price, duration and scope; the overall technical scores and the combined ranking are required only in the borrower’s notification of its intention to award, sent to each bidder. That notification must also tell each bidder why its bid failed, unless the scores already show it, how to ask for a debriefing or complain during the standstill period, and when that period ends.5 How the standstill works is set out in our field note on development-bank procurement rules.
Two procurements advertised before the local-labour requirement took effect show what the award notices give. Mozambique’s transport ministry tendered the bus rapid transit (BRT) infrastructure works for the Maputo metropolitan area in a notice dated , with rated criteria at 60% and price at 40%. Its award notice of lists each evaluated price and the reasons for rejecting bids; the winner’s evaluated price, US$92,341,384.78, is the lowest listed, and every score field is empty. Sierra Leone’s transport ministry called for initial selection on for the design and build of four long-span bridges and their link roads in two lots, under the Regulations of . The two award notices of show each lot won at the lowest evaluated price listed, with one bidder rejected on each for non-compliance and no scores shown.1, 6, 7, 8, 9, 10 From the public record, a bidder sees the price each winning bid was evaluated at, but not how far quality carried it; even its own notification need only give overall technical scores, not the mark for its method statement.
Zambia and Mozambique: two road notices, two different signals
On , Zambia’s Road Development Agency invited bids under the Seventh Edition to rehabilitate about 237 km of the Serenje–Mpika road (T2), in two lots of 118 km and 119 km, each with 36 months to complete. Rated criteria and bid cost carry 50% each. Within the rated criteria, local employment, skills transfer and community engagement carries a weight of 10 out of 100, against 40 for construction methodology and programming, 20 for environmental, social, health and safety, risk and traffic management, and 15 for key personnel and contract management capacity; a further 15 covers contract management, subcontracting strategy and local supplier participation. By our arithmetic, that criterion carries 5% of the combined evaluation. Every bid must come with a bid security of US$1,500,000 per lot, a declaration on sexual exploitation, abuse and harassment, and a Local Labour Method Statement; the notice does not state the percentage. As of , the Bank’s notice and the agency’s own notice set the deadline at 10:30 local time on , while the agency’s online tender listing shows .11, 12, 13
In a notice of , Mozambique’s national roads administration, ANE, invited design-and-build proposals, in one stage with two envelopes and no prequalification, under the Seventh Edition, for lot 1 (0 to 88 km) of the N1 between Chimuara and Nicoadala: 24 months of design and construction, then a one-year defects notification period and a three-year warranty period. As of , its notice mentions no local-labour requirement, no method statement and no rated criteria or weightings; proposals are due at 10:00 local time on , although the notice’s record in the Bank’s notice data gives .14
What the Bank’s design-and-build documents leave out
The Bank announced the requirement on , naming the construction and maintenance of transport and energy infrastructure among the civil works it covers. The Seventh Edition of its Regulations, of , leaves the percentage to the Bank’s standard procurement documents; the Bank’s guidance explains that this lets the figure change without revising the Regulations. The Regulations apply the requirement to all internationally procured works where those documents must be used, and the guidance says borrowers must always use their latest version. The guidance also says the standard documents for internationally procured works contracts have been updated to reflect the requirement.1, 5, 15, 16
On , though, the framework page’s list for projects at high risk of sexual exploitation, abuse and harassment dated the request for bids for works , but its two design-and-build requests for proposals, single-stage and two-stage, and its request for bids for output- and performance-based road contracts . Those three versions contain no local-labour clause and no Local Labour Method Statement form. The notice offers the request for proposals for sale to interested eligible proposers, for a non-refundable fee of MZN 6,500 or US$100.2, 14, 17, 18, 19, 20 As of , only that document can show whether ANE wrote in the 30%; the Bank’s design-and-build documents in those versions give it no clause to copy.
