How road authorities buy works, and when a contractor’s chance is decided

Road authorities often decide who gets their work before any scheme is let: in a framework competition covering years, or an area-contract round where a firm can win only one. The Texas Department of Transportation instead lets work monthly, behind an annual prequalification capping how much of its work a firm may hold.

Requests to participate in National Highways’ Scheme Delivery Framework 2 (SDF2), an eight-year framework to renew and maintain the existing assets of England’s strategic road network of motorways and major A roads, closed on ; the framework is expected to run from to .1 That one competition settles who can be awarded work under SDF2 for its whole term. The Texas Department of Transportation (TxDOT) opens bids for construction and maintenance contracts every month, at a statewide letting in Austin held on two consecutive days.2

Between the two sit the area and network maintenance contracts of Ireland, Spain and Sweden, each let for a fixed term. For a bid team, the question is less which scheme to chase than which gate stands in front of the work, and when it next opens.

A framework competition settles years of work

The SDF2 notice estimates the framework’s value at £14.5 billion excluding VAT over its projected eight years, and says it builds on two earlier National Highways frameworks, the Scheme Delivery Framework and the Pavement Delivery Framework.1 Under the Procurement Act 2023 a framework must include its estimated value; the Cabinet Office’s guidance explains that the estimate covers all the contracts to be awarded under it, and that payments are made under those contracts, not under the framework itself. It is an estimate of what may be ordered, not money committed to any supplier.8, 9

A framework under the Act is a contract that provides for future contracts to be awarded to the suppliers on it, through a competition among them unless the framework sets out the core terms and an objective way of choosing the supplier. SDF2 will allow both, award without further competition and a competitive selection process, with procedures that differ across its lots. The Act limits such a framework to four years unless the contracting authority considers that the nature of the works requires a longer term, in which case it must give its reasons in the notice.1, 8, 10 Among National Highways’ reasons: at its market engagement, the supply chain preferred an eight-year framework to a four- or six-year one. In the EU, Directive 2014/24/EU allows a framework agreement to run longer than four years only in exceptional cases duly justified, and contracts under it may be awarded only to the economic operators that were party to it when it was concluded.1, 11

SDF2’s 64 lots show where a specialist can enter. One national lot is for a main contractor that delivers and manages complex schemes, through its own work and subcontracts, across the scope of any other lot except design; ten kinds of work, among them pavements, structures, road markings, signs and lighting, and restraint systems, have six regional lots each; tunnels have one national lot, and technology design two regional lots. Each maximum number invited to tender applies to all the regional lots of a kind together: at most 15 suppliers can be invited across the six pavements lots and 20 across the six lots for general civils, drainage and concrete, with 10 for the main-contractor lot and 4 for tunnels. Every lot is weighted 70% on quality and 30% on price.1

A road-markings or restraint-systems firm that is not appointed to its region’s lot cannot be awarded contracts under SDF2; for work let under SDF2, the route left to it is as a subcontractor, for example to the main contractor.

A framework without a competition

Germany’s federal motorway company, Die Autobahn GmbH des Bundes, buys some planning services through an open-house framework that makes no selection, set out in a notice of . Any firm that meets the admission requirements can join it, for each area of work in which it proves them, among them road maintenance schemes, inner-city federal roads and drainage, at any time while the procedure remains open: currently until , after a one-year extension announced on . The original notice also provided for one further one-year extension, to . The notice states that this is not the award of a public contract under Directive 2014/24/EU, that the procurement review chamber is not competent to review it, and that challenges to its conditions can be taken to the administrative courts. Admission makes a firm a party, not the holder of any order: call-offs follow the arrangements set out in the framework agreement.12, 24

Area contracts come back in generations

Transport Infrastructure Ireland’s notice of for the third generation of its motorway maintenance and renewals contracts (MMaRC3G) describes its 5,306 km national road network in three regions, each with a sub-network under its own maintenance and renewals contract; TII intends to appoint three contractors, one per sub-network, and set up a fourth lot in case a fourth network is needed. TII is to shortlist up to eight applicants (a stated minimum of five if enough submissions comply, though TII may invite fewer) and invite them to tender for every lot; a tenderer can win only one. The contracts can run for up to 12 years (eight years, extendable by up to 48 months in all), and TII estimates spending under them at about €1.6 billion, saying the actual spend could likely be between €0.7 billion and €2 billion, allowing for inflation and excluding VAT.3

In Spain, the Directorate-General for Roads (Dirección General de Carreteras) put the maintenance and operation of six road sectors out to tender in a notice of , as six lots of one open procedure for services contracts estimated at €187,928,016.40 in all: a firm could bid for all six but be awarded only one. Each runs for 24 months, with extension provided for.4

Sweden’s transport administration, Trafikverket, lets basic road maintenance area by area, in open procedures and well before the work starts. Its notice for the Västerås area, published on , covers to , with an option of one or two more years, at an estimated SEK 288,000,000. The Blekinge notice of covers to , at an estimated SEK 612,000,000.5, 6

In Ireland and Spain the one-lot limit means no contractor can take a whole round, and in Ireland, Spain and Sweden alike a firm that loses an area gets no second chance at that contract while it runs, up to 12 years in Ireland. The model can also end: Main Roads Western Australia says its move to in-house delivery of road maintenance and some minor capital work is complete, and lists the transitions of its maintenance contracts as complete on dates from to .13

Monthly lettings: the gate is the balance sheet

TxDOT’s letting is the official receipt and opening of bids and the naming of the apparent low bidder; its districts hold local lettings as well, and it publishes the statewide letting dates for the current and following fiscal year.2 To receive a bid proposal at all, a contractor must be prequalified, at one of three levels that each need renewing every year; the level normally used for construction requires an audited financial statement from an independent CPA firm.7

Prequalification sets a bidding capacity, the most a contractor may have under contract with TxDOT at any one time; at the level normally used for construction it is the net working capital in the contractor’s financial statement multiplied by a factor TxDOT sets. A lighter level, the bidder’s questionnaire, is for projects on which TxDOT waives the full requirements, normally smaller construction, routine maintenance, emergency and specialty projects: it needs no financial statement, but limits a contractor to $1 million of capacity unless it submits a compiled or reviewed statement. A contractor may request proposals only for projects whose engineer’s estimate does not exceed its capacity less the TxDOT work it already has under contract, and its prequalification papers must arrive at least 10 days before the letting. The monthly rhythm offers many chances to bid, but each contract won uses up capacity: a contractor near its limit cannot request proposals for a project whose estimate exceeds what is left, until its work under contract falls or its working capital grows.7

Florida writes its gate into law: contractors must be prequalified by the Florida Department of Transportation to bid for road, bridge or public transportation construction contracts above $250,000, and the annual prequalification sets their approved work classes and a maximum capacity rating; maintenance contracts need none. Neither state requires subcontractors to be prequalified: TxDOT says they must still be registered with the Texas Secretary of State and in the federal E-Verify program, and Florida requires no prequalification to bid as a subcontractor in any amount. Main Roads Western Australia uses a national gate: prequalification under Australia’s National Prequalification System is mandatory for most of its road and bridge construction contracts, whatever their value, and a contractor prequalified with another participating agency may apply for mutual recognition.7, 14, 15

On federal-aid highway contracts, federal rules limit both parts of the gate: prequalification may be a condition of bidding or award only if the time between the call for bids and the bid opening lets a bidder obtain it, and a limit on how much work a contractor may bid for or be awarded is approved only if it rests on a full and appropriate evaluation of the contractor’s capability. In California, Caltrans’s Construction Manual says state law requires contract information to be published in the California State Contracts Register before plans and specifications are made public, and that Caltrans allows at least three weeks before bid opening, more for complex projects; emergency projects may have a shorter advertisement period.16, 17

In design-build, CM/GC and ID/IQ projects, federal rules let a state DOT use its own qualification or prequalification procedure for any phase of procurement. For NHHIP 3C-2, the reconstruction of the I-10, I-45 and I-69 mainlanes in Harris County, TxDOT chose a design-build contract: the Texas Transportation Commission authorised a request for qualifications on , and TxDOT issued it on . There the first gate is a qualification round, as in a framework competition, not the monthly letting.16, 18

Seeing the next competition coming

Where a gate opens only once in several years, the forward plans matter more than any single notice. Trafikverket publishes its procurement timetable as a spreadsheet and a map, grading each line by how certain its planned month of publication is, and warns that the data are preliminary and that new needs can arise at short notice.19

In the Netherlands, Rijkswaterstaat says it publishes a procurement plan three times a year, usually in March, June and November, listing the contracts it intends to tender one to two years ahead. As of , its planning page, last changed on , says it expects its 2027–2030 programming can be fixed at the end of 2026, that it then expects to publish a fully updated plan, and that none will be published in the meantime.20 Its page on major maintenance, as of , says that the proposed prioritisation of all national infrastructure projects, made known in a letter to parliament of , will first be discussed with the House of Representatives and then decided politically at the spring budget memorandum of 2027, on the basis of which Rijkswaterstaat can update its procurement planning.21

Under the Procurement Act 2023, a contracting authority other than a private utility that considers it will pay more than £100 million under its contracts in the coming financial year must publish a pipeline notice within 56 days of the year’s first day. The notice lists the contracts above £2 million for which it intends to publish a tender or transparency notice in the 18 months from that day.22 National Highways’ pipeline notice of covered SDF2 and estimated its tender notice for ; the tender notice came on . Here the pipeline gave the competition but not its timing: a bid team that planned on its date would have found requests to participate already closed, on .1, 23
